Salaah of a traveller

Assalamoalaikum Warahmatullahi Wabarakatuh

I have 3 questions regarding reading Salah during travel.

1. I will be returning from overseas and have been away overseas for just over a week. I have been reading shortened Salahs during this period. I live in Mt Roskill and upon returning to NZ will go directly from the Airport into a 14 days Quarantine in a MIQ hotel most probably in Central Auckland. Do I continue with the shortened Salahs while in Quarantine during the 14 days or revert to reading full Salahs as I am back in Auckland but not been home in between.

2. Is the ruling 14 or 15 days excluding the day you start your travel to shorten Salah.

3. Are we allowed to join Zuhr/Asr and Maghrib/Isha together when travelling as this seems to be a popular thing amongst the younger element in our community.

In the Name of Allaah, the Most Gracious, the Most Merciful

We have received your query dated 20/09/2021, our response is as follows:

  1. Due to Auckland (Mount Roskill) being your general place of residence, therefore, upon entering the boundaries of Auckland you will pray complete Salaah and not Qasr i.e., the shortened Salaah. Thus, the boundary of one’s suburb will not be considered (when calculating one’s journey) when it is attached to other suburbs and the greater metropolitan city/town, but rather the suburb will form part of the town/city in as far as the rules of travelling is concerned.   2. When one reaches one’s destination, then his intention of residing therein for fifteen days or more will be taken into consideration. [2]
  3. According to the Hanafi Madhab it is not permissible to join two Salah together in one time regardless of travel or not. The only exception is in Muzdalifah and Arafat during the days of Hajj. Allah Ta’ala states in the Noble Qur’an:

ان الصلاة كانت على المؤمنين كتابا موقوتا

“Indeed salaah has been made obligatory for the Mu’mineen at fixed hours (and can therefore not be brought forward)” (Surah Nisa , V.103) 

The Hanafi jurists deduce from the above Ayah of the Noble Quran that each salah should be prayed at its appointed time, irrespective of whether the person is a traveller or a resident. In a Hadith narrated by Hadrat Abdullah Bin Masood Radhiyallau Ahnu he says :

” I never observed Rasoolullah Sallallahu Alayhi Wasallam perform any prayer out of its time except at Muzdalifa. He combined Maghrib and ‘Isha at Muzdalifa.

وأشار الي انه يشترط مفارقة ما كان من توابع موضع الإقامة كربض المصر وهو ما حول المدينة من بيوت ومساكين فانه في حكم المصر وكذا القرى المتصلة بالربض في الصحيح…واما الفناء وهو المكان المعد لمصالح البلد كركض الدواب ودفن الموتى والقاء التراب، فان اتصل بالمصر اعتبر مجاورته وان انفصل بغلوة او مزرعة فلا كما يأتي (رد المحتار: ج ٢-ص١٢١-سعيد) وكذا في الهندية ص ١٣٩-ج١-رشيدية)

و لا يزال على حكم السفر حتى ينوي الإقامة في بلدة او قرية خمسة عشر يوما أكثر (الفتاوي الهندية: ص ١٣٩-ج ١-رشيدية)

او ينوي إقامة نصف شهر بموضع صالح لها… (در المختار مع رد المحتار: ص ١٢٥-ج ٢-سعيد)
